RESPONSE FROM WISCONSIN AG REQUEST FOR MANDAMUS

This is a summary of my letter dated March 15, 2019 to the new attorney general Josh Kaul on a request that an action for mandamus be brought asking the court to order release of the records as set forth in Chapter 781 and 783 of the Wisconsin Statutes.

The response dated 1-29-2019 and 2-28-2019, for Public Records Request #13731, demonstrates obstruction, avoidance, malfeasance, and contrary to the public policy favoring disclosure.

According to the DOC response there were no inmates released by the Earned Release Review Commission, no inmates discharged from extended supervision, and no rules establishing criteria and guidelines for exercise of discharge from extended supervision under Act 28 law beginning Oct. 1, 2009 and its repeal Aug. 3, 2011.  There were nor records provided that show releases after the repeal of Act 28 by Act 38 that the Wisconsin Supreme Court and Appeals Court determined unconstitutional in 2014.

Although state records obtained by the Journal Sentinel in July 2010 show 158 inmates were released early and Governor Jim Doyle estimated 500 to 1000 inmates would be released through June 2011.  Secretary Raemisch approved 45 felons and according to agency records 29 inmates were released and the earned Release Review Commission, formerly the Parole Board, released 113 inmates during this time period.  Please contact me with information about when I might expect the filing of the information to enforce the public records law and obtain the remedies specified in Wis. Stat. Section 19.37.
